Costco Agrees to $9 Million Settlement with San Diego-Area Pharmacists
Costco Wholesale Corp. agreed to settle for $9 million a putative class action filed against them by pharmacists from the San Diego area claiming that they were pressured to work overtime without pay and forced to remain on call during their breaks.
Costco will pay almost $5,000 to each of the approximately 1,175 pharmacist managers and pharmacists with Costco tenure dating back to April 2010 for allegedly violating California labor law. The lawsuit was initially filed in April 2014, and entered mediation in March 2017 before it was finally settled in June.
“This relief — averaging over $4,900 per class member — is particularly impressive when viewed against the difficulties encountered by plaintiffs pursuing wage and hour cases,” plaintiffs' attorneys said in the motion. “Moreover, by settling now rather than proceeding to trial, class members will not have to wait (possibly years) for relief, nor will they have to bear the risk of class certification being denied or of defendant prevailing at trial.”
