Verdict of $500 Million in Johnson & Johnson Hip Implant Trial

Hip Implant X-RayA Texas federal jury ordered Johnson & Johnson to pay roughly $500 million to five individuals who claimed to be injured by the Pinnacle metal-on-metal hip implants made by DePuy. After the two-month trial, the jury deliberated for a week, after which they found the hip implants had a defective design. DePuy was also accused of failing to warn patients about the risks involved.

The plaintiffs were awarded $140 million in compensation, as well as roughly $360 million in punitive damages. J&J plans to appeal the decision according to a company spokeswoman.

This was the second federal trial involving Johnson & Johnson’s Pinnacle device, the first of which J&J was cleared of liability. In total, there are over 80,000 cases that have been consolidated in the Texas federal court system.

The five plaintiffs in this lawsuit claim that the defects in the design caused bone erosion, tissue death, and metal in the blood. The lawsuit alleged that despite DePuy’s advertisement of a long-lasting, safe, and durable metal-on-metal hip implant, they received products that failed quickly and more frequently than they initially believed.

The Pinnacle hip implant was discontinued from sale in 2013, the year in which they settled over 7,000 lawsuits and paid out roughly $2.5 billion.
