Experience and Practice: Mr. Allen (Scott) began his practice by clerking for the Texas Supreme Court. Following his clerkship Mr. Allen went to work as an associate trial attorney at the national law firm of Andrews & Kurth where he focused his practice on the defense of doctors in medical malpractice cases and as counsel on products liability and other litigation matters. Scott was made a partner in 1991 and continued his practice there until becoming one of the founding members of his own firm, Cruse Scott Henderson & Allen LLP (CSHA) in 1992.
While at CSHA, Scott was head of the firm's mass tort group which from 1992 - 2008 handled many thousands of lawsuits where his doctor clients were named as defendants in pharmaceutical and medical device cases. Scott was named by Texas' largest medical malpractice carrier as coordinating counsel in all drug and medical device cases. Scott's cases involved silicone gel breast implants,fen-phen, Norplant, Propulsid, Baycol and hormone replacement therapy, among others. Scott was appointed by both Texas and federal courts as either liaison counsel or as a member of the steering committee for the physicians. Mr. Allen was asked to speak at numerous seminars where the role of doctors in litigation was a topic.
While at CSHA, Scott was also hired by other attorneys and injured individuals to assist them in lawsuits involving personal injury against major corporations and drug manufacturers. Scott also represented individuals and companies in the commercial litigation setting. Scott acted as lead counsel or co-lead counsel and has received both multimillion dollar jury verdicts and settlements. These verdicts include the trial of a case involving the ephedra containing product, Metabolife, which soon lead to the settlement of many other ephedra lawsuits in Texas and across the country. Scott also was trial counsel for a doctor in her suit against a major healthcare corporation. This case resulted in another multimillion dollar verdict. In addition, Scott has handled and settled either before trial, or during trial, other multimillion dollar cases. These include cases for wrongful death following one of the largest gas well explosion death and injury incidents in U.S. history, injuries from chemical exposure, drug product injury, breach of joint venture agreement in development of commercial web business, industrial accident and automobile injuries.
Mr Allen was lead trial counsel in the only case involving the pharmaceutical Zyprexa tried in the country -- The State of Alaska vs. Eli Lilly. Mr. Allen represented Alaska in their 2008 trial against Eli Lilly which settled after 5 weeks of trial and only a few days before the case was to be handed to the jury. Mr. Allen has continued to work on other pharmaceutical cases including those involving Seroquel and other drug products. Since 2005, Mr. Allen has also been one of the lead trial attorneys for the injured workers and surviving family members in cases involving the deaths and injuries of U.S. civilian truck drivers in Iraq. In this role, Mr. Allen has been asked to appear as a witness before a U.S. Senate committee and he and his clients have appeared in a documentary on the subject. Scott's work and his cases have been reported upon both locally and nationally, including The Houston Chronicle, The New York Times, The CBS Evening News and Bloomberg News among others. Mr. Allen joined Bailey Perrin Bailey as "Of Counsel" in June 2010 and will focus his practice on representing injured individuals in pharmaceutical and medical device cases, major industrial accidents, toxic torts and other cases involving catastrophic injuries and death as well as commercial disputes.
